These Terms and Conditions (“Terms”) govern your access to and use of the website, appointment-request forms, patient resources, communications, and related online services provided by The Nexus Group, PC (“The Nexus Group,” “we,” “us,” or “our”). By accessing or using our website or online services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use our website or online services.

1. Healthcare Services

The Nexus Group is an outpatient psychiatric practice providing services that may include psychiatric evaluation, medication management, Transcranial Magnetic Stimulation (“TMS”), Spravato treatment, and related behavioral-health services.

Information provided through our website is for general informational and educational purposes. It is not intended to:

  • Diagnose a medical or mental-health condition
  • Replace an evaluation by a qualified healthcare professional
  • Establish a provider-patient relationship
  • Provide individualized medical advice
  • Guarantee eligibility for any treatment
  • Guarantee a particular treatment outcome

A provider-patient relationship is established only after you have completed the required intake process and have been accepted as a patient by an authorized provider.

2. Emergencies

Our website, appointment forms, email, patient-support channels, and SMS services are not continuously monitored and must not be used for emergencies.

If you are experiencing a medical or mental-health emergency, call 911 or go to the nearest emergency room.

If you or someone else is experiencing a suicidal or mental-health crisis, call or text 988 to contact the Suicide & Crisis Lifeline.

Submitting an online form, leaving a voicemail, sending an email, or sending a text message does not guarantee an immediate response.

3. Appointment Requests

Submitting an appointment request does not guarantee an appointment, establish a provider-patient relationship, or confirm that we can provide the requested service. Appointments are not confirmed until you receive confirmation from our team.

You are responsible for:

  • Providing accurate and current contact information
  • Responding to scheduling communications
  • Providing requested intake or insurance information
  • Attending scheduled appointments
  • Following applicable cancellation and rescheduling policies

We may decline, cancel, or reschedule an appointment when reasonably necessary, subject to applicable law and professional obligations.

4. Eligibility and Age Requirements

Our clinical services are intended for adults aged 18 and older. By requesting services, you represent that you are at least 18 years old and legally capable of agreeing to these Terms.

Our website is not directed to children under 13. A parent, guardian, or legally authorized representative must provide any legally required authorization for information concerning a minor.

5. Insurance, Billing, and Payment

Information regarding insurance participation, coverage, treatment costs, and payment is provided for general informational purposes and may change. Insurance coverage is determined by your health plan. Verification of benefits is not a guarantee that your insurer will pay for a service.

You are responsible for:

  • Confirming coverage with your insurer
  • Providing accurate insurance information
  • Paying applicable deductibles, copayments, coinsurance, and non-covered charges
  • Complying with applicable billing and payment policies

Specific financial obligations may be governed by separate patient agreements, financial policies, or consent forms.

When you provide an email address or telephone number, you authorize us to communicate with you electronically as permitted by law and according to your communication preferences. Electronic communications may include:

  • Administrative messages

Standard email and SMS communications may not be encrypted. Do not send unnecessary sensitive medical information through ordinary email, text messages, or general website forms.

9. SMS and MMS Messaging Terms

By voluntarily providing your mobile telephone number and selecting an applicable consent checkbox, you agree to receive the selected categories of SMS or MMS messages from The Nexus Group, PC.

Providing a telephone number and consenting to SMS communications are separate actions. SMS consent is optional and is not required to submit a form, request or schedule an appointment, receive healthcare services, or make a purchase. Consent checkboxes are not selected automatically. You must affirmatively select each category of messages you wish to receive.

You must be 18 years of age or older to use this SMS service.

9.1 Non-Marketing Messages

If you opt in to non-marketing messages, messages may include:

  • Appointment confirmations and reminders
  • Scheduling and rescheduling updates
  • Patient portal notifications
  • Billing or account updates
  • Care-coordination communications
  • Responses to patient or customer-support requests
  • Other administrative or service-related messages

9.2 Marketing and Promotional Messages

If you separately opt in to marketing and promotional messages, messages may include:

  • Treatment options

  • Practice events
  • Special announcements
  • Other marketing or promotional communications

Consent to receive marketing or promotional messages is not a condition of receiving healthcare services or making a purchase.

9.3 Message Frequency

Message frequency varies depending on your appointments, requested services, account activity, and communication preferences.

9.4 Message and Data Rates

Message and data rates may apply to messages sent to you from us and to messages you send to us. If you have questions about your text or data plan, contact your wireless provider.

9.5 Cancellation and Opt-Out

You may cancel the SMS service at any time by replying STOP. After you send the SMS message “STOP,” we will send you a confirmation message stating that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from the applicable messaging program.

If you want to receive messages again, you must sign up and provide consent again through the same process used for your original enrollment.

Opting out of marketing messages does not automatically cancel non-marketing messages when you have separately consented to receive them. You may reply STOP to opt out of the applicable messaging program.

Opting out of SMS does not prevent us from contacting you through other authorized methods for treatment, payment, healthcare operations, safety, legal compliance, or other purposes permitted by law.

9.7 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

9.8 Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9.9 Privacy Policy

Our collection and use of information through the messaging program are governed by our Privacy Policy.

10. Consent Records

We may retain records documenting:

  • The telephone number provided
  • The consent language presented
  • The categories of messages selected
  • The date and time consent was provided
  • The website, form, or other source through which consent was provided
  • Subsequent opt-out or re-enrollment requests

These records may be maintained to operate the messaging program, honor communication preferences, resolve disputes, and demonstrate compliance.
